1. Agreement and authority

These terms apply to your access to and use of dondimday.com and its public pages, including its author and book information, articles, coaching and consulting information, and digital-resource storefront. By using the site, you agree to these terms. If you do not agree, do not use the site.

You must have legal capacity to agree to these terms. If you use the site or purchase a resource for an organization, you confirm that you are authorized to act for that organization.

2. Site content and professional services

The site is operated by Dondi M. Day under the public author name Dr. Dondi M. Day. It provides general information about books, writing, leadership, coaching, consulting, contract and claims management, and related resources. Site content is educational and informational; it is not legal, financial, tax, human-resources, medical, or other professional advice, and it is not a substitute for advice from a qualified professional who understands your circumstances.

Viewing or using the site, sending an inquiry, or purchasing a digital resource does not create an attorney-client, consulting, coaching, mentoring, or other professional relationship. Any professional engagement requires a separate written agreement signed by the parties.

3. Intellectual property and permitted use

Unless a page says otherwise, the site's text, original articles, photographs, graphics, book descriptions, design, and other content are owned by Dondi M. Day or used with permission and are protected by applicable intellectual-property laws. Book covers, retailer marks, and third-party materials remain the property of their respective owners.

You may view the site and share links to its public pages for lawful, personal, or organizational reference. You may not copy, republish, sell, distribute, or create commercial products from site content without written permission, except where applicable law permits.

Paid digital resources have a separate, limited license stated in the Purchase and Delivery Terms. That license does not transfer copyright or permit resale, public distribution, or use for another organization's consulting or paid training work.

4. Acceptable use

Use the site lawfully and do not attempt to disrupt, damage, probe, or gain unauthorized access to the site, its services, or another person's information. Do not use automated means to copy or harvest site content in a way that violates these terms or applicable law.

Do not send confidential, sensitive, or legally privileged material through a general inquiry. An inquiry does not create a duty of confidentiality.

5. Purchases and third-party services

Digital-resource purchases are subject to the separate Purchase and Delivery Terms shown at /resources/#purchase-terms. Those terms describe pricing, payment, delivery, license scope, and refunds and are incorporated into the applicable resource order. If a product-specific written agreement conflicts with these general site terms, the product-specific agreement controls for that order.

Payments are processed through Whop's hosted checkout when checkout is available. Retailers, payment providers, email providers, and other external services operate under their own terms and privacy practices. Dondi M. Day does not control third-party sites or promise their availability.

6. Availability and disclaimers

The site and its content are provided on an as-available basis. Content, links, availability, and offerings may change. Reasonable efforts may be made to keep information current, but no representation is made that every page is complete, current, uninterrupted, or error-free.

To the fullest extent permitted by law, the site is provided without warranties beyond those that cannot legally be excluded. Nothing in these terms removes a consumer or other right that applicable law does not allow to be waived.

7. Limitation of liability

To the fullest extent permitted by applicable law, Dondi M. Day is not liable for indirect, incidental, special, exemplary, or consequential losses arising from general use of the site. For a claim relating to a paid digital resource, any total liability will not exceed the amount paid for the specific resource giving rise to the claim, except where applicable law does not permit that limit.

Nothing in these terms limits liability that cannot legally be limited, including liability for fraud or intentional misconduct where such a limit is prohibited by law.

8. Changes to these terms

These terms may be updated when the site, offerings, or applicable requirements change. The date at the top of this page identifies the latest revision. Changes apply prospectively from the posted date; an order already placed remains subject to the terms presented for that order, except where applicable law requires otherwise.

9. Governing law and venue

North Carolina law governs these terms, without regard to conflict-of-law rules. To the extent permitted by applicable law, a dispute relating to these terms or the site must be brought in a court of competent jurisdiction in Carteret County, North Carolina. If federal subject-matter jurisdiction applies, the dispute may be brought in the United States District Court for the Eastern District of North Carolina. This section does not waive a right or forum that applicable law makes nonwaivable.

10. General provisions and contact

If a court finds any part of these terms unenforceable, the remaining terms continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver. These terms and the applicable resource purchase terms are the complete terms for use of this site, except for any separate written agreement.
